SUMP ONLINE TERMS & CONDITIONS

1. DEFINITIONS
1.1. “Card” refers to the Customer’s debit and/or credit card intended for payment of the Parts.
1.2. “SUMP” refers to Springbok Used Motor Parts, registration number: 1999/006912/07;
1.3. “Customer(s)” refers to a consumer purchasing Parts on the website and/or a user of the website, regardless of whether an account is registered.
1.4. “Parts” refers to automotive products supplied and sold by SUMP to the Customer.
1.5. “Party (ies)” refers to the Customer and/or SUMP, jointly or separately, as applicable.
1.6. “Quotation” refers to the quote sent to the Customer, stipulating the price of the Parts and ancillary charges.
1.7. “Reserved” refers to a temporary hold on the purchase amount in the Customer’s bank account before payment for the Parts is effected.
1.8. “Terms and Conditions” refers to these terms and conditions along with any referenced documents.
1.9. “Website” refers to https://sump.co.za/.

2. RECORDAL
2.1. SUMP operates the Website.
2.2. The Customer wishes to purchase Parts from SUMP’s website.
2.3. SUMP supplies and sells Parts to Customers subject to these Terms and Conditions as well as SUMP’s Standard Terms and Conditions which can be found on https://sump.co.za/. In the event of any conflict between these terms and conditions and SUMP’s Standard Terms and Conditions, SUMP’s Standard Terms and Conditions shall prevail with respect to purchases made by the Customer.
2.4. By using the Website, the Customer agrees to be bound by these Terms and Conditions.

3. IMPORTANT CLAUSES
3.1. These Terms and Conditions apply to Customers who are consumers under the Consumer Protection Act 68 of 2008 (“CPA”).
3.2. These Terms contain clauses that:
– 3.2.1. Limit the risk or liability of SUMP;
– 3.2.2. Create risk or liability for the Customer;
– 3.2.3. Notify the Customer of a third party’s liability;
– 3.2.4. Require the Customer to indemnify SUMP;
– 3.2.5. Serve as an acknowledgement and acceptance by the Customer of certain facts.
3.3. Customers must read these Terms and SUMP’s Standard Terms and Conditions carefully.
3.4. If any clause is unclear, the Customer must seek clarification from SUMP before accepting these Terms.
3.5. These Terms do not unlawfully restrict any rights or obligations under the CPA.
3.6. By using this Website, the Customer accepts these Terms unconditionally.
3.7. The Customer must not use this Website if they do not agree to be bound by these Terms.

4. REGISTRATION AND USE OF THE WEBSITE
4.1. Only registered Customers may order Parts on the Website.
4.2. To register, the Customer must provide a unique username, password, and personal information.
4.3. The Customer agrees to:
– 4.3.1. Use their username and password for personal use only;
– 4.3.2. Keep their login details confidential.
– 4.3.3. The Customer must enter the correct login details to access the Website.
– 4.3.4. The Customer is responsible for logging out of their account.
– 4.3.5. The Customer indemnifies SUMP against any unauthorised access using their login details.
4.4. The Customer agrees not to interfere with the Website’s functionality.
4.5. The Customer must notify SUMP immediately if they suspect unauthorised access.

5. CONSUMER PROTECTION ACT
5.1. These Terms comply with the Consumer Protection Act 68 of 2008 (“CPA”).
5.2. The CPA does not apply to juristic persons exceeding the threshold set by the Minister.

6. PERSONAL INFORMATION
6.1. The Customer must provide personal information when registering an account.
6.2. The Customer must update their information as necessary.
6.3. The Customer warrants that all provided personal information is accurate and indemnifies SUMP against claims resulting from false or misleading information.
6.4. SUMP will use personal information only for order processing, delivery, and related communications.
6.5. SUMP will not disclose personal information to third parties without consent, except to:
– 6.5.1. Employees and third parties managing orders and deliveries;
– 6.5.2. Law enforcement if illegal activity is suspected;
– 6.5.3. Comply with legal obligations.
– 6.5.4. SUMP will take reasonable steps to protect the Customer’s personal information.
– 6.5.5. SUMP is not liable for unauthorised access to personal information unless due to gross negligence.
– 6.5.6. The Customer indemnifies SUMP against unauthorised third-party use of their personal information.

7. PRICES AND QUOTATIONS
7.1. Customers place orders specifying required Parts.
7.2. SUMP will source Parts as per the provided specifications.
7.3. The Customer is responsible for ensuring the specifications are accurate.
7.4. Quotes remain valid for 7 (seven) days.
7.5. Parts are not reserved until payment is received.
7.6. Payment must be made upon approval of the quotation.
7.7. Orders are offers to purchase Parts and require payment confirmation.
7.8. Orders are subject to availability.
7.9. Orders may be cancelled if the Parts are unavailable.
7.10. No contract exists until payment is received and Parts are delivered.

8. ERRORS
8.1. SUMP is not obligated to provide Parts at incorrect prices.
8.2. If an order is rejected, the Customer will be refunded within 30 (thirty) days.

9. PAYMENT
9.1. Payment methods include:
– 9.1.1. Debit/credit card;
– 9.1.2. Direct bank deposit or EFT;
– 9.1.3. Online payment via Peach Payments.
9.2. Note: Peach Payments shall be the preferred payment gateway for all transactions conducted. The Customer acknowledges and agrees that Peach Payments provides a seamless and secure payment processing solution. Accordingly, the Customer shall prioritise the use of Peach Payments for its payment processing needs.

10. DELIVERY
10.1. Delivery is subject to availability.
10.2. Delivery will be via a nominated courier.
10.3. Delivery charges will be quoted.
10.4. Estimated delivery times are not guaranteed.

11. UNLOADING
11.1. The Customer must provide a means for unloading Parts.
11.2. SUMP is not liable for damage during unloading.

12. WARRANTIES AND DISCLAIMERS
SUMP makes no warranties regarding the quality or operation of the Parts.

13. RETURNS AND REFUNDS
13.1. Returns are accepted under the following conditions:
– 13.1.1. The item is undamaged and unused;
– 13.1.2. A return request is submitted within 7 (seven) days;
– 13.1.3. The return is not prohibited by the CPA.
13.2. The Customer bears the courier cost for returns.
13.3. Exchanges are not permitted; the Customer must place a new order.
13.4. Refunds will be processed in the original payment method where possible.

14. COOKIES
14.1. The Website uses cookies to enhance user experience.
14.2. Disabling cookies may affect website functionality.

15. TERMINATION
15.1. SUMP may suspend or terminate orders for non-payment.
15.2. SUMP may blacklist users for misuse.

16. GOVERNING LAW
These Terms shall be governed by the laws of South Africa. The parties shall first attempt to resolve any disputes through amicable negotiation. If unsuccessful, the parties agree to proceed with mediation before resorting to litigation. The Customer acknowledges and agrees to these terms.

Disclaimer: These Terms and Conditions constitute the entire agreement between the Customer and SUMP. SUMP disclaims all liability for any damages, losses, or claims arising from or related to the use of its products, services, or any transactions with SUMP, to the fullest extent permitted by law. SUMP shall not be liable for any direct, indirect, incidental, consequential, or special damages of any kind, including but not limited to loss of profits, data, or business opportunities. SUMP shall only be held liable for any claims or damages if and to the extent that such liability is conclusively determined by a final judgment of a court of competent jurisdiction.
